Insurer refuses to pay accident victim's hire car replacement cost
Imagine having your car significantly damaged by a careless driver. And imagine the inconvenience of having your car off the road for 35 days whilst it is being repaired.
That was the situation faced by Julia when her Nissan X-Trail was taken off the road due to the negligence of a thoughtless driver.
During the repair period Julia needed to hire a replacement car whilst her car was unavailable.
Unfortunately the insurance company of the negligent driver refused to pay for the cost of the hire car.
Galaxy Legal was briefed by Julia’s solicitor to represent her in Court to recover the cost of the car hire.
In her hour of need Julia hired a Mitsubishi ASX from Compass Claims.
Darryl was able to prove that Julia had acted reasonably in hiring a replacement Mitsubishi ASX for 35 days whilst her vehicle was being repaired. Further the Court was satisfied that Julia needed a hire car and that the rate charged by Compass Claims was fair and reasonable.
As such Julia was able to recover the full amount of the car hire from the other driver’s insurance company.
